RELEASE, INDEMNITY AND HOLD HARMLESS AGREEMENT

In consideration of being permitted to participate in any Activity (which hereinafter includes Events) hosted by the Inland Northwest Pickleball Club (INWPC), I agree to the following:

Assumption of Risk.  I am voluntarily participating in an Activity with knowledge of the risks, hazards, and other dangers involved.  I accept any and all risks of injury (including death), accident, illness (including disease), property loss or damage arising from, during, after or in any way connected to the Activity, whether the occurrence is on or off the pickleball court. 

Release.  I hereby waive, release, and forever discharge the Inland Northwest Pickleball Club, its officers, directors, agents, volunteers,  (collectively the “Releasees”) from any and all claims for personal injury, death, accident, illness, or property loss or damage.

Indemnification.  I, to the fullest extent permitted by law, shall indemnify, hold harmless, protect and defend INWPC and Releasees from and against any and all liabilities, claims, damages, losses, demands, lawsuits, costs, and expenses, including but not limited to attorney fees brought as a result of my involvement in the Activity.

Financial Responsibility.  In the event that I should require medical care or treatment for illness or injury sustained as a result of my participation, I agree to be financially responsible for any costs incurred. 

Severability.  If any provision of this Agreement is held invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement will nevertheless by fully valid, enforceable, and unimpaired by such holding.
